    jThe Justice department’s Office of Inspector General’s (OIG) long-awaited report said department leadership knew the policy would result in children being separated from their families and that the former US attorney general Jeff Sessions “demonstrated a deficient understanding of the legal requirements related to the care and custody of separated children”.

    In a conference call in May 2018, Sessions told prosecutors: “We need to take away children,” according to notes taken by people on the call and provided to the OIG.


    Rosenstein, who publicly denounced the policy for the first time on Thursday, told the OIG he had known the zero-tolerance policy would result in family separations. He also told investigators he had not been involved with the formulation of the policy and had received reassurances about it that he now believed were wrong.

    Family separation, which legal experts and doctors said constituted torture, was supported by multiple federal agencies.

    The homeland security department (DHS) separated families at the border and detained the parents, the health department eventually took custody of children separated from their parents and the justice department leadership provided the legal framework that made separations possible.


    The justice department OIG report confirms earlier watchdog reports from the other agencies’ monitors, which found inadequate tracking systems were in place.


    A January 2019 report from the health department OIG found the Trump administration might have separated thousands of migrant children from their parents at the border for up to a year before family separation was a publicly known practice.


    The lead attorney on an ongoing family separation lawsuit brought by the American Civil Liberties Union, Lee Gelernt, said: “This new report shows just how far the Trump administration was willing to go to destroy these families. Just when you think the Trump administration can’t sink any lower, it does.

    The Trump administration’s “zero tolerance” policy meant that any adult caught crossing the border unlawfully would be prosecuted for illegal entry.

    Because children cannot be jailed with their family members, families were separated and children into different types of detention, with minors taken into custody by the health and human services department, which manages unaccompanied children at the border.

    While the rescinding of “zero tolerance” is in part symbolic, it undoes the Trump administration’s hugely unpopular policy responsible for the separation of more than 5,500 children from their parents at the US-Mexico border.

    Most families have not been prosecuted under that policy since 2018, when the separations were halted, though separations continued on a smaller scale.


    Biden also wants to offer a path to legal status for an estimated 11 million undocumented immigrants living in the US.


    Some of the parents separated from their children were deported. Advocates for the families have called on Biden to allow those families to reunite in the United States.


    Trump’s then attorney general, Jeff Sessions, in 2018, along with Trump and other top leaders in his administration, were bent on curbing immigration.


    The “zero tolerance” policy was one of several increasingly restrictive policies aimed at discouraging migrants from coming to the southern border.


    The policy was a disaster. There was no system created to reunite children with their families and some children are still separated.


    Meanwhile, a federal judge on Tuesday barred the US government from enforcing a 100-day deportation moratorium that is a key immigration priority of the new president, Joe Biden.

    US district judge Drew Tipton issued a temporary restraining order sought by Texas, which sued last Friday against a Department of Homeland Security memo that instructed immigration agencies to pause most deportations.

    Chỉ cần đừng miệt thị người đến cầu cạnh mình, cho người ta một cơ hội nộp đơn xin tị nạn. Xét đơn không chấp thuận hay chấp thuận đều thuộc vào luật pháp và chính sách tị nạn của mỗi quốc gia. Nếu không chấp thuận thì cho mớ tiền xe để họ hồi hương. Làm việc như vậy là hợp pháp và nhân đạo. Trong việc xét đơn xin tị nạn sẽ có vô số trường hợp bẻ cong lương tâm để làm lợi cho quốc gia. Nhưng đó cũng là hợp pháp. Legitimate. Không ai có thể chê trách gì được.

    Còn những đứa trẻ bị tách ra rồi chỉ còn cách hợp thức hóa cho những đứa trẻ được sống hợp pháp và đưa vô các chương trình đoàn tụ gia đình.

    A central piece of the Tuesday actions is the family reunification taskforce, which is charged with identifying and enabling the reunification of all children separated from their families by the Trump administration.

    Biden officials said they could not name how many children had to be reunified because the policy was implemented without a method for tracking the separated families. In an ongoing court case, a reunification committee said in December that the parents of 628 children had not been located.

    The task force will consist of government officials and be led by Biden’s nominee for secretary of homeland security, Alejandro Mayorkas, who is set to be confirmed on Tuesday.


    A senior administration official said the family separation policy was a “moral failure and national shame” and that reversing the policies which made it possible was a priority.
