Classification opens way for surveillance of party and is likely to revive discussion of a ban.

Một trong nhiều công việc của Cơ quan Bảo Hiến Liên Bang Đức là quan sát các đảng phái để bảo vệ Tự Do Dân Chủ ở Đức. Việc quan sát có 3 cấp:

• Cấp thứ nhất là: Trường hợp cần điều tra
• Cấp thứ nhì là: Trường hợp có nghi phạm
• Cấp thứ ba là: Trường hợp có chính sách cực đoan đã được chứng minh

Khi một đảng phái đã bị rơi vào trường hợp thứ ba, có nghĩa là công tố viện đã có bằng chứng đảng đó vi hiến, đã có bằng chứng rồi đấy. Khi một đảng rơi vào trường hợp này, công tố viện có quyền áp dụng việc điều tra, theo dõi cá nhân đảng viên mọi lĩnh vực xã hội dân sự như nghe lén điện thoại, các mạng xã hội .v.v.v

Ngoài ra mọi quyết định vẫn còn phải qua sự đồng ý của thượng và hạ viện khi có chứng từ của bên công tố viện. Không có ai (thượng và hạ viện) được quyền "thảo luận" việc bãi bỏ tư cách pháp lý một đảng phái nào khi chưa có trình tự tố cáo của cơ quan bảo hiến và qua xét xử của tòa thượng phẩm (tòa áo đỏ) cả.
